Terms of Use
Effective date: [the day the app goes live]. These terms are an agreement between you and ("we") for the Table Rock Navigator app and this website. By using the app you agree to them. If you don't agree, don't use the app.
1. Not for navigation
- The app is a planning and entertainment aid. It is not a nautical chart, a depth sounder or a substitute for your own eyes and judgment.
- Depths come from a 2020 government survey adjusted to the lake level, and the strip along the bank is estimated. Buoys, docks, hazards, no-wake zones, routes, arrival times, weather and lake levels can be missing, misplaced, late or wrong. Rocks, stumps and floating debris may not be shown at all.
- Routes and warnings are suggestions. Always keep a lookout, obey the buoys and markers on the water, slow down when you are unsure, and follow Missouri and Arkansas boating law and the U.S. Army Corps of Engineers' rules.
- Don't operate the app in a way that distracts you from running the boat. Let a passenger handle the phone.
- In an emergency call 911. The app's emergency screen only helps you find the right numbers.
2. Who can use the app
You must be at least 13 years old to create an account. If you are under 18, a parent or guardian must agree to these terms for you.
3. Your account
- Give accurate information and keep your sign-in details to yourself. You are responsible for what happens under your account.
- You can delete your account at any time in the app or from our support page.
- We can suspend or close an account that breaks these terms.
4. What you post
- Hazard reports, map fixes, suggested edits and tips must be honest, about the lake, and clean: no swearing, sexual content, hate, threats, bullying, spam or advertising. Don't post other people's private information.
- Don't send false reports. Other boaters rely on them.
- You keep ownership of what you post. You give us permission to use, display, edit and share it in the app and to improve the map, without payment.
- We can remove anything, for any reason, and we filter and review posts. Other boaters' reports and tips are their own and we don't guarantee them.
5. Location and friends
Location sharing with friends is off until you turn it on. Use it responsibly and only with people you know. See the Privacy Policy for how location is handled.
6. Paid features and subscriptions
- Some features may require a purchase or a subscription. The price and what it includes are shown before you buy.
- Purchases are made through your Apple or Google account and are billed by them.
- A subscription renews automatically at the end of each period, at the price shown, until you cancel. Cancel at least 24 hours before the period ends to avoid the next charge. You manage and cancel subscriptions in your Apple or Google account settings; deleting the app does not cancel a subscription.
- Refunds are handled by Apple or Google under their policies.
7. Ads and other businesses
The app may show featured places, events and ads. Businesses shown in the app are separate from us. We don't guarantee their hours, prices, services or what they tell you, so call ahead.
8. Our rights in the app
The app, its design and its map are owned by or used under license; credits are listed in the app under "About, terms and credits". You may use the app for your own personal boating. You may not copy, scrape, resell or redistribute the map or its data, reverse engineer the app, or use it to build a competing product.
9. No warranty
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose and uninterrupted service. Cell coverage on the lake is spotty and the app may not work when you need it.
10. Limit of liability
To the fullest extent the law allows, and its owner are not liable for any injury, death, property damage, grounding, collision, fine, lost profit or other loss arising from use of the app or reliance on anything it shows. If a court finds us liable anyway, our total liability is limited to the greater of what you paid us in the 12 months before the claim or $50.
11. Your responsibility
You agree to cover our reasonable costs if a claim against us results from your breaking these terms or the law while using the app.
12. Changes and ending
We may change the app or these terms. If a change is significant we will tell you in the app, and continuing to use the app means you accept it. You can stop using the app at any time.
13. Governing law
These terms are governed by the laws of the State of Missouri. Any dispute will be brought in the state or federal courts located in Missouri.
